Peaceful Protest Not a Crime: Madras High Court Quashes FIR Against Hindu Munnani Workers

The Madras High Court (Madurai Bench) has reaffirmed a fundamental democratic principle — peaceful protest is not a crime. In a significant ruling, the Court quashed a 2020 FIR registered against members of Hindu Munnani, holding that the police acted mechanically and failed to establish any unlawful conduct.
The FIR, registered at K.Pudur Police Station, Madurai, named 85 persons and invoked Sections 145, 151, and 283 of the Indian Penal Code. The petitioners, seven among the accused, approached the High Court seeking quashing of the case.
Justice L. Victoria Gowri observed that the complaint merely recorded the petitioners’ participation in a protest and did not attribute any specific act such as violence, obstruction, nuisance, or disturbance to public order. The Court categorically held that criminal law cannot be set in motion based on vague and omnibus allegations.
The petitioners argued that their protest was entirely peaceful and that the denial of permission to ensure their assembly, while allowing a “Religious Harmony Group” to protest at the same venue on the same day, amounted to hostile discrimination under Article 14 of the Constitution.
Rejecting the State’s contention that the investigation was still at a preliminary stage, the Court held that the FIR itself lacked the essential ingredients required to constitute offences under the IPC provisions invoked.
Justice Gowri emphasized that Articles 19(1)(a) and 19(1)(b) of the Constitution guarantee freedom of speech and the right to peaceful assembly. These rights can be curtailed only through reasonable restrictions prescribed by law, not by arbitrary police action.
Finding that continuation of the proceedings would amount to an abuse of process of law, the Court exercised its inherent powers under Section 528 of the Bharatiya Nagarik Suraksha Sanhita (corresponding to Section 482 CrPC) and quashed the FIR insofar as the petitioners were concerned.
